North Dakota Security Deposit Statute
The key North Dakota security deposit provision is N.D. Cent. Code Section 47-16-07.1. This page translates the parts renters usually need most.
Cap and account rule
The statute generally limits ordinary security to one month's rent, with listed exceptions. It also requires security deposit money to be kept in a federally insured interest-bearing savings or checking account for the tenant's benefit.
Pet deposit rule
A pet security deposit for a non-service, non-assistance animal is separate from the ordinary cap. It may not exceed the greater of $2,500 or an amount equal to two months' rent.
30-day itemization and notice
Within 30 days after termination of the lease and delivery of possession by the renter, the landlord must deliver or mail the itemization and amount due to the renter at the last address furnished to the lessor, along with written notice.
The notice must state any amount still due to the landlord or the refund due to the renter.
Deductions and treble damages
The statute allows application of deposit money and accrued interest for listed categories, including unpaid rent and certain damage, cleaning, or repair costs. A landlord is liable for treble damages for security deposit money withheld without reasonable justification.
