North Dakota's security deposit deadline is 30 days after termination of the lease and delivery of possession by the renter.
Protect the address record
Give your current mailing or forwarding address in writing and keep proof. North Dakota does not make that address the deadline trigger, but the itemization and amount due are mailed or delivered to the last address furnished to the lessor.
What the landlord must send
Within 30 days after lease termination and delivery of possession, the landlord must deliver or mail the itemization and amount due with written notice.
The notice must state:
- any amount still due to the landlord, or
- the refund due to the renter
If deductions are taken
Any application of deposit money not returned to the renter must be itemized by the landlord. That itemization matters because North Dakota limits deductions to specific categories and excludes reasonable wear and tear from cleaning or repair charges.
What to keep
Keep:
- the lease
- deposit payment proof
- lease termination date
- proof you returned possession or keys
- the written mailing or forwarding address you furnished
- itemization and written notice, if any
- refund records
- photos, videos, move-in condition statement, invoices, estimates, and messages about deductions
