Use court only after the record is clearer
Illinois small claims may be an option if your landlord will not return your security deposit or will not resolve unsupported deductions. The case is generally filed in Illinois Circuit Court, but local filing, service, fees, and venue details can vary.
Before filing
Before court, organize the facts that usually matter:
- landlord name and address
- rental address
- move-in and move-out dates
- date your right of possession ended, if different
- deposit amount and payment proof
- current mailing address or verified email address proof
- demand-letter date and delivery proof
- itemized statement, receipts, estimates, follow-up receipts, and refund records
What to claim
Keep the claim tied to the amount owed and the proof. Illinois can support twice the amount due, court costs, and reasonable attorney's fees only when the required court findings are made. Do not assume extra recovery is automatic.
If the property is in Chicago or another municipality with local rules, check whether local ordinance claims affect the case.
