Small claims may be the next step if a Hawaii landlord still will not return the deposit or provide the written reasons after you have the proof in order.
The small-claims track
Hawaii Judiciary materials say a residential security-deposit return claim belongs in small claims court, and the amount disputed in small claims generally cannot exceed $5,000.
What to prepare
Bring the case back to the basic proof:
- lease and deposit payment records
- move-out notice
- surrender and key-return proof
- current mailing address proof
- photos and videos
- written reasons or itemization, if any
- receipts or estimates, if any
- written demands and delivery records
- calculation of the amount still owed
What the court will likely care about
For a deposit dispute, the practical issues are usually the 14-day rule, whether the landlord sent written reasons, whether deductions were itemized, whether receipts or estimates were included, and whether the renter can prove the amount owed.
