Move-Out Checklist (Delaware)
A cleaner move-out record makes a deposit dispute easier to handle. The best time to protect the deposit is before the landlord controls the story.
In Delaware, the record should show the expiration or termination date, possession delivery, condition, deposit amount, and your written forwarding address.
Before You Move Out
Document the condition
- take photos and video before you remove everything
- take photos and video after cleaning and emptying the unit
- save any move-in inspection photos or notes
- keep repair requests and landlord responses
Confirm the timeline and address
- save the lease
- document the expiration or termination date
- document possession delivery
- provide a written forwarding address
- keep proof that the forwarding address was sent
On Move-Out Day
- remove belongings
- return keys or document how possession was returned
- take final photos
- save any text or email confirming move-out
- keep proof of delivery for your forwarding-address notice
After You Move Out
Track the 20-day deadline.
Delaware requires the deposit balance, and any itemized damages list with remaining balance, within 20 days after the rental agreement expires or terminates.
If the landlord sends payment with an itemized damages list and you disagree with the withheld amount, respond in writing within 10 days after receiving it. Be specific about which damages, costs, or normal-wear charges you dispute.
