Delaware Security Deposit Deadline (20-Day Rule)
Delaware's security deposit deadline is 20 days, but the forwarding-address record can affect the strongest remedy path.
The landlord must return the deposit balance within 20 days after the rental agreement expires or terminates.
If the landlord claims deductions, the landlord must send the itemized damages list and any remaining balance within that same 20-day period.
What the Landlord Must Provide
If deductions are taken, the landlord must provide an itemized damages list.
That list should identify the damages and the estimated cost of repair for each listed damage.
If you only get a vague number, a partial refund with no explanation, or no accounting at all, that is a problem.
If the landlord sends payment with an itemized damages list and you disagree with the amount withheld, object in writing within 10 days after receiving it.
Forwarding Address Matters
Delaware's written forwarding-address rule is important.
Provide your forwarding address in writing at or before termination of the rental agreement.
If the tenant fails to provide that written address, the landlord's obligation to give notice and double-damages exposure can be limited.
That does not automatically let the landlord keep unused deposit money. The landlord can still owe the unused portion if the tenant makes a written claim within 1 year after the rental agreement expires or terminates.
That is why Step 1 documents your forwarding address before the deposit dispute gets harder. The one-year written-claim fallback matters if you did not give the forwarding address at or before termination, but it is not a reason to wait.
What If the Deadline Is Missed?
If the landlord wrongfully withholds your Delaware deposit, you could win double the amount wrongfully withheld in court. That is leverage, especially when you can show the 20-day deadline, written forwarding-address proof, missing or incomplete itemization, and the amount still owed.
That makes the expiration or termination date, forwarding-address proof, itemized damages list, lawful deductions, normal wear and tear, written objection timing, and refund balance the facts to organize first.
