Alabama landlords can use a security deposit for accrued rent and damages caused by tenant noncompliance.
If the landlord keeps any money, the landlord should send an itemized accounting within the same 35-day period used for the deposit return.
Common deduction disputes
Common disputes include:
- unpaid rent
- cleaning charges
- repair charges
- replacement costs
- vague fees
- charges that look like ordinary wear and tear
The issue is not just whether the landlord lists a charge. The issue is whether the charge is allowed, supported, and explained.
What to look for in the accounting
Look for:
- what each charge is for
- the amount of each charge
- whether it relates to rent or tenant-caused damage
- whether the charge is vague or duplicated
- whether any remaining balance was returned
- whether the accounting was mailed within 35 days
Ordinary use is different from damage
Light scuffs, aging, and ordinary use are different from broken fixtures, large stains, missing items, or damage caused by misuse.
Photos and move-in records help show the difference.
